In my opinion, based on my experience as a seller, I found her to be extremely unethical, & very dishonest. My contract allowed me to terminate the agreement in writing anytime after June 19, 2006 without penalty. I notified her in writing on August 20, 2006 that I wanted my home taken off the market. She stalled & then demanded $250 to help cover her marketing costs which she said was in the contract. After she discovered that it was not, she demanded that I amend my contract to reflect that I would pay her $250 to terminate the contract to help cover marketing costs, which the original contract states I am not responsible for. She would not honor the contract & terminate the agreement & remove my home from the market until I signed the form. I never signed the form. Towards the end she said I could cross off the $250 part from the amend/extend form. I will not sign this. I do not trust her at all at this point. I found out that all she needed to take my home off the market and terminate the contract was my original written request. WHat makes things worse is that she called me before this and asked if my dad could do an emergency repair on a home she had sold and the baseboard in the kitchen had been broken by a contractor. I went to the home with my father and he did a beautiful job fixing it even though the general condition of the home was abysmal. She was very happy that he fixed it and he never charged her anything in good faith that she may work hard to sell my home. Now he is very ill with a major surgery that has complications. She realizes that it is very difficult for me to make my house payments. Prior to my rates increasing I got some lender offers and when I mentioned to the lender that my home was on the market they told me I could not refinance so long as the home is on the market. More than 42 days have passed with me struggling to work enough hours to make the payments and taking care of my dad. Still, Beth sticks to her guns, insisting she must have this form signed. In the end she has said I can just cross off the part about the $250. I am not stupid! The form is an Amend/Extend contract form does not say it will terminate this contract. In fact it says" The date ending the Listing Period or Duration of Agency/Duration Relationship is extending to upon mutual execution." Her supervisor, spoke with me twice was misled at first. She told him it was a misunderstanding and that I was just not wanting to pay this money. Of course I dont want to pay something that came out of the blue, was never even discussed and that was not in the contract! On the second phone call he was still insisting to me that she needed that signed form for her records and I could cross off the $250.00 part. That is crazy! That form could still be enforceable and has nothing to do withterminating the agreement! I have everything documented in e-mails- CONSUMER PLEASE BEWARE- BBB, ethics, & Colorado State Board Complaints filed. :(
